Yusuf Siddiqui's application for a practising certificate for the practice year 2024/2025 is granted subject to the following interim conditions:
- Mr Siddiqui is not to be a compliance officer for legal practice (COLP) or compliance officer for finance and administration (COFA) for any authorised body.
- Mr Siddiqui is not to be an Anti Money Laundering Officer or Anti Money Laundering Compliance Officer or Anti Money Laundering Reporting Officer (MLRO) for any authorised body.
Reasons/basis
The above interim conditions are made under rule 3.2 of the SRA Regulatory and Disciplinary Procedure Rules, which states that at any stage an authorised decision maker may, pending a final decision by the SRA or the Solicitors Disciplinary Tribunal, impose interim conditions on the practising certificate of a solicitor. We are satisfied that these conditions are necessary in the public interest or for the protection of the public.

Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Siddiqui :-
- From 31 January 2023, failed to maintain accurate and compliant books of accounts and in doing so failed to show that the Firm held sufficient funds in its client bank account to match its liabilities to clients.
- On or around 20 November 2022 in relation to the transfer of the property, failed to conduct a proper assessment of his client's capacity to provide instructions.
- From 20 November 2022 and throughout the period of the retainer acted for and was instructed by two current clients and in doing so acted where there was a conflict of interest of a significant risk of a conflict of interest between two current clients.
- During the transaction of the property transfer, failed to consider his client's right to remain at the property following completion of the property transaction.
- During the transaction to transfer the property, charged his client a disproportionate and unjustified fee.
- Allowed client money to be transferred into his personal bank account and subsequently failed to ensure that this was paid promptly into a client account.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
