I have decided to grant approval under Section 41 of the Solicitors Act 1974 to Hennah Haywood Law Limited to employ Michael Thompson as a coveyancing assistant, subject to the following conditions:
- Mr Thompson’s employment at the firm is limited to that outlined in the firm’s application of 28 August 2024 and supplementary email of 12 December 2024.
- Mr Thompson’s supervision is as per the details provided to us in the firm’s application of 28 August 2024 and supplementary email of 12 December 2024. This includes his work being directly supervised by Mr Nathan Hennah and, in Mr Hennah’s absence, by Ms Jodie Lewis.
- Any outgoing correspondence on matters worked on by Mr Thompson must be signed by a solicitor at the firm.
- Mr Thompson does not have access to any office or client account, is not a signatory to any office or client account and does not have any responsibility for the firm’s accounting functions.
- Mr Thompson will not be responsible for supervising any other member of staff.
- Mr Thompson will not have direct contact with clients. Sensitivity: Confidential
- Any proposed variation to Mr Thompson’s job description or supervision arrangements are notified to the SRA in advance of the change taking place. The variation must not take place until permission is granted by the SRA.
- This approval will lapse if Mr Thompson’s employment with the firm is terminated.
- This approval and the conditions attached to it are subject to review at the discretion of the SRA.
Reasons/basis
Mr Thompson was made subject to an order under section 41 of the Solicitors Act 1974 on 28 July 2024. In accordance with section 41 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain our approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
